LIABILITY WAIVER FORM
This release and Waiver of Liability (the “Release”) executed on this day of, by the undersigned volunteer in favor of Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central Va Inc., Their Trustees, Directors, Officers, Employees, and Agents (collectively Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc.,)
I hereby freely and voluntarily, without duress, execute this Waiver under the following terms.
Waiver and Release. I the volunteer release and forever discharges and hold harmless Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter, arise from my work at Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., I understand and acknowledge that this Release discharges Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., from any liability or claim that I may have against Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., with respect of bodily injury, personal injury, illness, death, or property damage that may result from participation on the Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., worksite. Whether caused by the negligence of Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., or its Officers, Directors, Employees, Agents, or otherwise .It is also understood that Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance in the event of injury, illness, death or property damage.
Insurance. I the volunteer understand that I expressively waive any such claim for compensation or liability on the part of Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc.
Medical Treatment. I hereby release and forever discharge Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., from any claim whatsoever which arises or may here after arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during my time with Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc.
Assumption of Risk. I understand that my time with Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., may include activities that may be hazardous to me, including, but not limited to the operation or being around the operation of wood cutting and splitting equipment, loading and unloading firewood and local transportation to and from the wood site and being delivered to the homeowner. I hereby expressly and specifically assume the risk of injury or harm in these activities and release Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc., from all liability from injury, illness, death, or property damage resulting from the activities of my time with Metcalf Tree and Landscape Services, Inc. & Start A Spark of Central VA Inc.
Photographic Release. I grant and convey unto Start A Spark of Central VA Inc., all right, title, and interest in any and all Photographic Images and Video and Audio recordings made by Start A Spark of Central VA, Inc. during my work for Start A Spark of Central VA Inc., including but not limited to any royalties, proceeds, or other benefits derived from such photographs, or recordings.
Other. I expressly agree that this waiver is intended to be as broad and inclusive as permitted by the laws of the state of Virginia in the United States of America, and that this waiver shall be governed by and interpreted in accordance with the laws of the state of Virginia. I agree that in the event that any clause or provisions of this waiver shall be held to be invalid by any court of competent jurisdiction the infidelity of such clause or provision shall not otherwise affect the remaining provisions of this release which shall continue to be enforceable.
